Is it legal for a felon to hunt with bow or crossbow in Texas?

I have a friend who has a felony, and he tells me he was told he can never legally hunt with a bow or crossbow in Texas.

I see this in the Texas hunting regulations:
quote:
Possession of firearms by felons: A convicted felon, regardless of where the conviction occurred, may
not possess or use a firearm (as defined by Penal Code, §46.01) to hunt in this state. Under Penal Code, §46.01,
a muzzleloading firearm is lawful if it is an antique or curio firearm manufactured before 1899 or a replica of
an antique or curio firearm manufactured before 1899 that does not use rimfire or centerfire ammunition.

But it doesn't say anything about felons and bows.

Are there criminal statutes in Texas than ban possession of a bow by a felon? Could there be some conflicting laws, where it says you can hunt with a muzzleloader, but another law that says you cannot possess a firearm of any kind?

My understanding is that felons can hunt with bows, crossbows, and muzzleloaders, but they are not legally allowed to possess (or hunt with) a firearm. I do not have any legal means to back this up, though.

What are you doing hanging around felons? Just kidding.

Bows and crossbows should be perfectly legal for him from what I understand.

So this applies to all felons, regardless of whether or not their crime involved a gun? Interesting.

Learning new laws here. I knew CHL holders could not have been convicted of a felony, but I didn't realize there were restrictions on hunting.

There are restrictions on gun possession and ownership (i.e. in your own home), outside of hunting.

Sometimes decent people get on the wrong track and make very stupid decisions, esp. in their youth. And they carry that decision around for the rest of their life, because having a felony is a much bigger deal than not owning guns. It makes getting a job very difficult.

I knew a guy in Wyoming who was a convicted felon. He was an avid black powder shooter. His rifles were current manufacture, super expensive Shiloh Sharps single shot Quigley Down Under type rifles. I think they were made up in Cody, Wyoming or somewhere in Montana.
Anyway, the felon/firearm law is federal, not state law isn't it?

The main restriction, you are right, seems to be federal law. However it appears that state law also comes into play. Because, for example, while a felon could hunt with certain blackpowders in Texas, they can't in Wyoming. Everything I have seen so far indicates that in Texas a felon can hunt with bow and certain blackpowder rifles.

I might be of some assistance. My dad, who I haven't spoken with in years, is a convicted felon and bow hunts for precisely this reason.

The Duke boys had a parole restriction that they couldn't have guns... or leave the county. Apparently Atlanta is in Hazzard County

I just called and spoke with the Grayson County Sheriff's Office (grayson only allows bow hunting of deer) and they said, yes, a felon can own a bow, however they need to do their research and check the pounds. There is some sort of limit on the pounds.

Shifty's friend is likely either dead, back in prison or has had the felony removed from their record by now.

Quality bump though. Keep researching and let us know what else you find in 6 years.

Its not illegal. A couple guys I worked with in the oilfield were felons and they used a crossbow to deer hunt.

very interesting law..

I have a family member who served 10 years in jail for a DUI crime.. He LEGALLY owns about 50 guns. His explanation was that since his crime was a non violent crime he is allowed to own firearms.

Unless he was able to get a pardon, I'm not quite so sure about that one. Talking with multiple ATF agents and they specifically said that the federal law is that once you get a felony, you are absolutely done. On the state level, I think there may be some gray areas but federal law doesn't really provide an avenue for gun right restoration.

and I think his explanation referred to firearms he owned prior to the felony conviction. I do not believe he is allowed to purchase a new firearm, now, with the felony.

You can apply for "relief" from the ATF and have second amendment rights restored, though I am sure it is a long and drawn out process. That being said, the family member that said he can have them since he owned them prior to conviction is full of it and asking for another felony.

There used to be a specific program for that. Since then, the antis got all up in arms about it and got it defunded. Since then, it's been kind of a funky process that doesn't have an official route. A couple of courts have been pushed to do it with mixed success.

You can petition to have your rights restored. The ATF has a process and each state has a process.

https://www.cga.ct.gov/2008/rpt/2008-R-0617.htm

I,worked with a guy in AZ that had a felony drug conviction that successfully petitioned to,have his firearm rights restored. I think it is fairly rare, but not unheard,of.

Hi everyone
After business paper shredders, I am looking for crossbow Brodhead (crossbow ammos) which do not penetrate during projection and gives larger blood trail. Please do suggest me some best price crossbow Brodhead that fits perfect in my crossbow. My budget is not more than 50$.....
Thanks, best regards

I think it was part of their deal to enter the union. They would be on perpetual probation.

Something tells me you should be busy sending out emails to help find the heir apparent to an African prince's throne and fortune.

But wow, two epic bumps in this seemingly insignificant thread.

I know this is an old thread but this is what I've been told as a felon without any violent crimes or drug charges. 10 yrs from date of conviction you can reapply for your gun rights from the ATF in such a case, although it's not a quick process and unlikely they will do it anyway. Doesn't hurt to try though.
