What is the "drop dead" (pun intended) date that the dems have to replace him on the ballots?

If he is nominated in the primaries, can they replace him with a hand picked alternate in the national election in November 2024? Or does it have to be his name and his running mate will take his place?


I would assume there is a rule for this after it gets out of the primaries. I understand that in the primaries the Dems will do whatever they want.

If it's after the convention but before the election, I think the electoral college decides

If the winning presidential candidate dies between Dec. 15 but before Jan. 6, Congress would have to decide whether to count the votes cast for them. If Congress chooses to validate the votes, the laws of presidential succession are carried out, and the winning candidate's vice president becomes president-elect. If Congress chooses not to validate the votes, however, the question will be whether the living candidate has a majority of the overall electoral votes. If they don't, then the 12th Amendment says the House of Representatives must elect the president from among the three candidates with the most votes.

In a two-person race, then, the breathing candidate wins.

It would be rather interesting if buden died between the electoral college votes and the House vote, thereby leaving a republican house to decide if Harris would be granted Biden's votes or if the republican should win. Given Harris' deep unpopularity, I'd wager a republican House would assume Harris wouldn't have gained the same vote total as biden and reward the presidency to Trump and/or whomever the republican candidate is.
