A new bill, the first of its kind in the U.S., would ban security screening company Clear from operating at California airports as lawmakers take aim at companies that let consumers pay to pass through security ahead of other travelers.

Sen. Josh Newman, a California Democrat and the sponsor of the legislation, said Clear effectively lets wealthier people skip in front of passengers who have been waiting to be screened by Transportation Security Administration agents.

"It's a basic equity issue when you see people subscribed to a concierge service being escorted in front of people who have waited a long time to get to the front of TSA line," Newman told CBS MoneyWatch. "Everyone is beaten down by the travel experience, and if Clear escorts a customer in front of you and tells TSA, 'Sorry, I have someone better,' it's really frustrating."


If passed, the bill would bar Clear, a private security clearance company founded in 2010, from airports in California.

Newman said his bill, SB-1372, doesn't seek to prohibit Clear from operating its own dedicated security lines separate from other passengers.

"The bill doesn't seek to punish Clear or put it out of business. It wants to create a better traffic flow so customers aren't intersecting with the general public and causing a moment of friction that is so frustrating to the average traveller," he said. "All it does is up the tension in the line."

Cali is only going after Clear because they can't do away with Pre-Check or Global Entry. That may be the strategy though...create another divisive issue and eventually force everyone to go back to the days of removing shoes/belts/etc.

Clear annoys the crap outta me. I have Pre-TSA and Global Entry. It's fine if Clear wants to operate and charge people to get through quicker. It's the American way. If I thought I needed it, I would join. But they just walk to the front of pre-TSA and barge in. Screw that, get your own line. Charge people whatever you want and pay an extra TSA agent to be just for Clear.

But, cutting a line, legally, gets them twisted in a knot about some people being treated better than others because of social status????

Even if you travel a lot, Clear feels like a waste of money relative to Pre Check. I feel like it's only marginally faster about 1/3 of the time.

We had Clear for a year when our credit card had a promotion to offer it to cardholders for free. Whenever we used it, we had to find the "Pre-Check/Clear Line" which was separate. I can't remember all the airports we visited that year but I know that was the case at Bush. I wonder if it has to do with the amount of traffic in the security lines as to whether or not they get their own line at any given point in the day...

Clear is BS. Who gave them the right to barge in front of everyone? I get the pre-check as it is government handled but Clear is selling something they shouldn't have the right to sell. Also what happens when everyone signs up for Clear? They will just up the prices more for those who can afford it, thus making the whole cost of travel inflate exponentially just for a middle man to make bank while the rest of us suffer.

Austin let's Clear barge in front of everyone, so if there is a line and it finally starts moving, you can all get stuck over and over because a big group with clear comes through and bumps you.

I'm sure different airports handle it differently, but I fly a lot and generally they just walk to the front of Pre-TSA with a Clear agent and barge right in. If they have their own line with their own dedicated agent, I got no problem with it.

I'll echo the sentiment.

I fly almost every week to 2 different cities.
I have precheck.
Just because someone sold their biometric data to a private company they can cut in front of me?!
Add in CLEAR has been found to not really be checking and let people without "CLEAR" or pre check to jump the lines and I think they should either go, or have to do their own screening.
The only people I'm ok with cutting in front is the pilots and cabin crew.
This might be the only time I agree with California.

Clear is a FedGov shell company. Muh private corporation conservatives are easy to dupe.

Clear has devalued their product significantly over time. It used to be a great product for mostly business travelers paying for the convenience of bypassing lines & some of the standard TSA bs.

Now because of free trials, credit card deals, cheap family member add ons, and limited Clear staffing, it's typically faster to just use the standard lines. When you see an abundance of folks in pajama pants & slippers and families with multiple kids in the Clear line, you know something is wrong.

But Clear has found their sweetspot on pricing that maximizes revenue, and its low enough that too many people are members. I expect Clear to come out with a Premier/Diamond level with another separate line for folks willing to pay $500/yr for actual convenience.
